Article 1: Application

Each order constitutes acceptance by the buyer of our general terms and conditions, which are an integral part of the agreement, to the exclusion of all other general or special terms and conditions issued by the buyer, unless expressly agreed otherwise in writing.

Article 2: Quotations and acceptance of the order

All our offers are without obligation. We are only bound by an order after we have confirmed it in writing or after we have started execution. The information about the products and the pricing, as well as the detailed order information, is prepared and communicated subject to change and correction.

Article 3: Payment

For payment you can choose from the following options: payments via Credit card, PayPal, iDEAL, Bancontact and bank transfer. Any inaccuracies in the invoicing must be reported by the customer directly to Petit Bonbon, so that we can correct the amount. If you pay by bank transfer, it can take a few days before we receive your payment. Orders are only shipped once we have received payment.

Article 4: Delivery

Products are only delivered in the countries for which the website allows delivery. The delivery of products will take place as far as possible within the time specified in the individual order confirmation. Incorrect delivery addresses are the buyer's responsibility and may lead to additional costs. Unless otherwise agreed, the prices do not include the transport and delivery of the goods to the buyer. The costs of transport and delivery are stated separately. The stated delivery times are not binding, but are given purely as an indication. No delay in delivery can give rise to termination of the purchase or payment of damages in favor of the buyer, except in the case of deliberate delay. We have the right to make partial deliveries. In the event of non-delivery of the goods, any sums paid by the buyer will be refunded without interest or other compensation.

If your package is returned to us because you did not fully provide your address, the costs (€7.5) for this return are for you. Make sure you enter the shipping address correctly and completely.

Article 5: Price

All sales prices stated on the website always include VAT, but exclude delivery costs and taxes. Delivery costs are determined throughout the purchase process and communicated to the user. The final total cost is explicitly and clearly stated in Euro and at the end of the purchase process, before the user definitively validates his purchase. The price quote refers exclusively to the articles as they are described in writing. The accompanying photo is for decorative purposes and may contain elements that are not included in the price. Petit Bonbon reserves the right to change certain prices, including delivery costs, at any time for whatever reason, but there is a commitment to effectively apply the published prices at the time of purchase by the user.

Article 6: Retention of title

The delivered goods remain our property until full payment of the price, including all costs and charges, default interest and compensation. In the event of non-payment, we reserve the right to take back the goods, by operation of law and at the expense of the buyer.

Article 7: Sanctions for non-payment

Without prejudice to the exercise of other rights available to Petit Bonbon, in the event of non-payment or late payment from the date of default, the customer will owe an interest of 10% per year on the unpaid amount by operation of law and without notice. In addition, the customer owes a fixed compensation of 10% on the amount concerned, by operation of law and without notice, with a minimum of 25 euros per invoice. Notwithstanding the foregoing, Petit Bonbon reserves the right to take back items that have not been paid (in full).

Article 8: Complaints

Any visible damage and/or qualitative shortcoming of an article or other shortcoming in the delivery must be reported immediately, under penalty of forfeiture of any right, to customer service. mail.petit.bonbon@gmail.com.

Article 9: Warranty and return

Legal guarantee (only for consumers): Under the law of 21 September 2004 on the protection of consumers in the sale of consumer goods, the consumer has legal rights. Each item is subject to the legal guarantee from the date of purchase by (if applicable delivery to) the first owner. Any commercial warranty does not affect these rights.

General: To invoke the warranty, the customer must be able to present the order confirmation or receipt and proof of payment. For items purchased online and delivered to the customer at the address indicated by him, the customer must contact customer service in advance at mail.petit.bonbon@gmail.com, after which the customer must return the item to Petit Bonbon at his expense. More information about how to return items can be found here. He has the option to exchange the articles or have them repaired via the workshop. The repair of an item does not entitle to a refund. Any defect must be reported within 14 days of its discovery. Afterwards, any right to free repair or replacement lapses. The (commercial and/or legal) warranty never applies to defects that arise as a result of accidents, neglect, falls, abnormal or incorrect use, use of the item contrary to the purpose for which it was designed, adjustments or changes to the item, heavy-handed use, poor maintenance or normal wear and tear. It also does not apply to articles with a shorter life, or wear articles. The warranty is not transferable.

Article 10: Withdrawal period

The provisions of this article only apply to customers who purchase articles on the website: the consumer has the right to inform Petit Bonbon that he renounces the purchase, without payment of a fine and without giving any reason within 14 days from the date of purchase. day following the delivery of the product. Customers who wish to make use of the right of renunciation must return the goods to Petit Bonbon at their expense within 14 days from the day following delivery. Only items that are in their original condition, unused, undamaged, with all labels and in original packaging can be returned. Under no circumstances will be taken back: used, soiled, damaged or incomplete items, items made to measure for the customer or items that have been worn. The Petit Bonbon items purchased online are not refundable through the stores or through other channels.

The seller undertakes to refund the purchase price of the product paid by the buyer (excluding shipping costs) within 30 days of receipt of the product to a bank account number determined by the buyer. In the event of incorrect return in accordance with the foregoing, the seller will not be obliged to pay any amount and the product remains the property of the buyer. He can then collect it back from the seller within 14 days or at the explicit request of the buyer and return it to the buyer at his expense. The risk of returning the product as well as the cost of returning it is borne exclusively by the buyer.

Article 11: Infringement of validity - non-renunciation

If any provision of these terms and conditions is declared invalid, illegal or void, this shall in no way affect the validity, legality and applicability of the other provisions. Failure at any time by Petit Bonbon to enforce any of the rights listed in these terms and conditions, or to exercise any right hereof, shall never be deemed a waiver of such provision and shall never affect the validity of those rights. .

Article 13: Shipping costs and term

Orders are shipped as soon as payment is received. Deliveries in Belgium will take on average 1 to 5 working days. Custom made items have a longer delivery time. On the website it is indicated that the delivery time of other items should be longer than 1 to 5 working days (if not, the customer will be notified). International deliveries depend on the destination country. Either regular mail (3.95 EUR) is chosen, which are not traceable, or it is opted for shipping via tracking (6.95 EUR), which is traceable. If shipping by regular mail (EUR 3.95) is chosen, the responsibility and risk lies entirely with the customer. The shipping costs are FREE for orders from 90 EUR WITHIN BELGIUM.

Article 14: Gift vouchers

A Petit Bonbon gift voucher is valid when purchased via the website www.petitbonbon.be. A gift voucher remains valid for 12 months from the date of issue. If the amount of the purchases exceeds the value of the voucher, the difference will be paid by the customer according to the usual method of payment. It may not be exchanged for money or any other means of payment, even partially.

Article 15: Changes in terms and conditions

These conditions are supplemented by other conditions that are explicitly referred to, and the general conditions of sale of Petit Bonbon. In the event of a contradiction, these terms and conditions shall prevail. Petit Bonbon may change these terms and conditions at any time without further notice. Any purchase after the change constitutes acceptance by the customer of these new terms and conditions.

Article 16: Evidence

The customer accepts that electronic communications and backup can serve as evidence.

Article 17: Intellectual property

  • Our website, designs, logos, text, photos, names and generally any communications are protected by intellectual property rights owned by us, our suppliers or other stakeholders.
  • It is prohibited to use and/or make changes to the intellectual property rights as described in this article. Drawings, photos, names, texts, logos, color combinations, etc. cannot be copied or reproduced without prior and express written permission.
  • Our designs and models are protected and deposited in an i-DEPOT. Counterfeiting is absolutely prohibited.
  • If intellectual property rights are infringed, this will be handled by the lawyer without warning.

Article 18: Applicable law - competent court

Belgian law applies, with the exception of the provisions of private international law on applicable law and of the Rome I Regulation on contracts for the international sale of movable property.
